Christie's has the right at its absolute discrétion to refuse any bid, to advance the bidding as it may décidé, to withdraw or divide any Lot, to combine any two or more Lots and in the case of dispute to put up any Lot for auction again. 4. (a) Any indemnity hereunder shall extend to ail actions, proceedings, costs, claims and demands whatsoever incurred or suffered by the person for whose benefit the indemnity is given; (b) Christie's shall hold any indemnity on trust for its employees and agents where it is expressed to be for their benefit. 5. Any notice given hereunder shall be in writing and if given by post shall be deemed to have been duly received by the addressee in the ordinary course of post. 6. The copyright in ail illustrations and written matter relating to the Lots shall be and remain at ail times the absolute property of Christie's and shall not without the prior written consent of Christie's be used by any person. 7. These Conditions of Business shall be govemed by and construed in accordance with English Law and ail parties concerned hereby submit to the non-exclusive jurisdiction of the English Courts. In these Conditions 'Bought in' 'Christie's' 'Expenses' 'Forgery' 'Hammer Price' 'Lot' 'Proceeds of Sale' 'Published Rates' 'Purchase Price' of Business the following words and expressions shall have the following meanings: those Lots which fail to reach their reserve. Christie, Manson & Woods Limited. Christie's charges for insurance, illustrations, spécial advertising, packing, import and freight and any VAT thereon. a Lot made or substantially made with an intention to deceive as to authorship, origin, date, âge, period, culture or source which is not shown to be such in the description in the catalogue and which at the date of the auction had a value materially less than it would have had if it had been in accordance with the description, the price at which a Lot is knocked down to the Buyer. any item deposited with Christie's with a view to its sale at auction whether on its premises or elsewhere with a view to its sale at auction and, in particular, the item or items described against any lot number in any catalogue. the net amount due to the Seller being the Hammer Price less commission at the Published Rates and Expenses and any other amounts due to Christie's or to any associated company of Christie's from tne Seller in whatever capacity and howsoever arising. Christie's rates of commission which are 10 per cent of the Hammer Price on Lots selling for L1,000 and above and 15 per cent on Lots selling for less than L1,000, except for wine where the commission is 10 per cent of the Hammer Price on each consignment of Lots selling for L1,000 and above and 15 per cent on each consignment of Lots selling for less than L1,000. In the case of Lots failing to reach their reserve, a charge of 5 per cent may be made on the last bid for ail Lots. There shall be a minimum commission of L50 levied on ail Lots, except for wine where the minimum commission shall be L30 and for coins and medals where the minimum commission shall be L15. VAT at the standard rate is payable on ail Sellers' commission, the Hammer Price plus any premium, VAT chargeable and additional charges and expenses due from a defaulting Buyer under Condition A 10, in pounds sterling. Note: Clause A.ll(b) does not apply to Coins and Medals, or Jewellery. INFORMATION FOR SELLERS AND BUYERS Terms of Sale Sellcr's Commission: Our commission from the Seller is 10 per cent of the price at which a Lot is knocked down to the Buyer ('the Hammer Price") on Lots selling for L1,000 and above and 15 per cent on Lots selling for less than L1,000, except for wine where the commission is 10 per cent of the Hammer Pricc on each consignment of Lots selling for L1,000 and above and 15 per cent on each consignment of Lots selling for less than L1,000. In the case of Lots faifing to reach their reserve, a charge of 5 per cent may be made on the last bid for ail Lots. There shall be a minimum commission of L50 levied on ail Lots, except for wine where the minimum commission shall be L30 and for coins and medals where the minimum commission shall be L15. Buyer's Premium: Buyers are reminded that there is a 10 per cent premium payable on the final bid of each Lot (see clause A4 of the Conditions of Business). Value Added Tax (VAT) (a) The Seller: VAT at the standard rate is payable on the Seller's commission and on such other charges as are liable to VAT within the UK (e.g. illustrations, insurance, etc.) by vendors who are EEC fiscal residents. Non-EEC resident Sellers are exempt from payment of VAT on these charges. (b) The Buyer: VAT is payable in ail cases on the premium and is non-refundable. Lots daggered (f) in the catalogue arc, in addition, subject to VAT on tne hammer price; if such a Lot is subsequently exported and proof of export is supplied in the correct form to Christie's Accounts Department the VAT paid on the hammer price is refundable. In the case of a Lot marked with a dagger (f) in the catalogue, VAT is payable in addition on the final bid, refundable on proof of export. In the case of second-hand goods which are dealt with for VAT purposes under the Special Scheme described in VAT Notices 712 and 724, H.M. Customs & Excise treat the final bid as the Seller's selling price and the Buyer's purchase price. Sellers Overseas There are no auction taxes in the United Kingdom. Paintings, drawings, prints, sculpture disposed of by the creator or as part of his estate before lst April 1973, collections and collector's pieces and antiques more than 100 years old ail enter the United Kingdom free of duty and without payment of VAT (explanatory leaflet on request). It is essential that ail items imported for sale must be declared as such to H.M. Customs at the point of entry into the United Kingdom, and appropriate documents obtained for présentation to us. The addresses of our overseas représentatives are at the back of this catalogue. Estimâtes The estimated selling price of each Lot is printed beneath the Lot description and does not include the Buyer's premium. Bidders should bear in mind that these are prepared wcll in advance of the sale and are not définitive. They are subject to revision. Commission Bids Christie's are always pleased to advise Clients and to execute bids on their behalf (subject to clause A12 of the Conditions of Business), and if successful the purchase price payable will be the final bid price and the premium of 10 per cent together with any VAT chargeable thereon (see clause A4 of the Conditions of Business). Bids must always be made or confirmed in writing or by telex, reference being made to each sale through the code name and Sale Number printed on the title page of each catalogue. A form for written bids is printed at the back of the catalogue. To cnsure that bids will be accepted and the delivery of Lots is not delayed, intending Buyers should supply bank or other suitable references to Christie's. The references should be supplied in good time to be taken up before the sale. Valuations Christie's undertake written valuations for probate, insurance, family division or other purposes. Charges are arranged by negotiation but will be refunded on items sent for sale at Christie's shortly thereafter. Inspections There is no fee for calling upon owners to advise on sale by auction in our rooms, although travel and out-of-pocket expenses may be charged. Ivory Prospective Buyers are advised that several countries (including the United States of America and a number of European Countries) currently prohibit the import of certain items that contain ivory. Accordingly, prospective Buyers should familiarise themselves with customs régulations relating to ivory (that have been adopted by the relevant country of import) prior to bidding for the Lot at the sale if they intend to import the Lot into such country. © Christie, Manson & Woods Limited (1990) 1-11/90
