Limited Warranty Christie's warrants the authenticity of authorship on the terms and conditions and to the extent set forth herein. Subject to the provisions of the last paragraph hereof, Christie's warrants for a period of six years from the date of sale that any article described in headings printed in UPPER CASE TYPE in this catalogue (as such description may be amended by any saleroom notice or announcement) which is unqualifiedly stated to be the work of a named author or authorship, is authentic and not counterfeit. The term "author" or "authorship" refers to the creator of the article or to the period, culture, source or origin, as the case may be, with which the creation of such article' is identified in the description of the article in this catalogue. Only UPPER CASE TYPE headings of lots in this catalogue (i.e., headings having capital-letter type) indicate the degree of authenticity of authorship warranted by Christie's. If this catalogue has a "glossary," the terms used in such headings are further explained therein. Any heading which is stated in the Glossary to represent a qualified opinion is not subjcct to the warranty contained herein. Christie's warranty does not apply to supplemental material which appears below the UPPER CASE TYPE heading of each lot in this catalogue and Christie's is not responsible for any errors or omissions in such supplemental material. The benefits of this warranty are not assignable and shall be applicable only to the original buyer of the lot and not subsequent assigns, purchasers, heirs, owners or others who have or may acquire an interest therein. This warranty is conditioned upon the buyer returning the lot to Christie's, 502 Park Avenue, New York, N. Y. 10022, in the same condition as at the time of sale. The buyer's sole remedy under this warranty shall be the rescission of the sale and refund of the original purchase price paid for the article. This remedy shall be exclusive and is in lieu of any other remedy which might otherwise be available as a matter of law, and the seller and Christie's shall not be liable for any incidental or consequential damages. Christie's limited warranty does not apply to the attribution of authorship of paintings, drawings, graphic art or sculpture created before 1870, unless such works arc determined to be counterfeit, as such attribution is based on current scholarly opinion, which may change. Absence of Other Warranties Except as specifically provided above under Limited Warranty, all property is sold "as is" and neither Christie's nor the seller makes any express or implied warranty or representation of any kind or nature with respect to the property. In no event shall Christie's or the seller be responsible for the correctness of, or be deemed to have made, any representation or warranty of merchantability, fitness for purpose, description, size, medium, genuineness, attribution, provenance or condition concerning the property, and no statement set forth in this catalogue or made at the sale or in the bill of sale or invoice or elsewhere, whether oral or written, shall be deemed such a warranty or representation or an assumption of liability. However, the foregoing disclaimer of implied warranties does not apply to articles produced after July 3, 1975. Christie's and the seller make no warranty or representation, express or implied, that the buyer of any work of art or other property will acquire any copyright or reproduction rights thereto.
