PREFACE
The fourth edition of Essentials of Business Law and the Legal Environment is in the tradition of accuracy, comprehensiveness, and authoritativeness associated with its earUer editions. This text covers the material presented in a nontechnical, but nonetheless authoritative manner. It covers the material succinctly, yet in depth sufficient enough to be easily comprehended by today's students.
This text is designed for use in Business Law and Legal Environment courses generally offered in universities, colleges, and schools of business and commerce. By reason of the broad coverage and variety of the material this volume may be readily adapted to specially designed courses in Business Law by assigning and emphasizing different combinations of the subject matter. All topics included in the CPA exam are covered by the text.
Emphasis has been placed upon the regulatory environment of Business Law: The first eight chapters are devoted to introductory coverage of the legal environment of business, and Part Nine (Chapters 42 to 47) thoroughly addresses the area of government regulation of business.
A new chapter has been added: Business Ethics. Moreover, full chapters have been established for material that previously had been covered as part of a chapter: Administrative Law, Suretyship, Accountants' Legal Liability, and Intellectual Property.
We have deemed it desirable to place primary emphasis on the text and to present the cases in summary fashion. Cases are briefed and integrated into the chapters. The facts are summarized in clear and understandable narrative using the names of the parties. The legal issues and court decisions are carefully explained with a minimum of legal jargon. The opinions have been drastically shortened, the reductions affording more satisfactory material for purposes of instruction. Using the headings FACTS, DECISION, and OPINION, most cases are adequately covered in 30 lines or less.
From long classroom experience we are of the opinion that fundamental legal principles can be more effectively learned from text and case materials having at least a degree of human interest. To accomplish this objective a large number of recent cases have been included. Landmark cases, on the other hand, have not been neglected. Moreover, Law in the News has been updated to provide the student with recent news articles that discuss the implications of the legal principles covered in the text.
To improve readability, all unnecessary "legalese" has been eliminated while necessary legal terms are printed in boldface and clearly defined, ex-
