Possibilities of Contact on the HungarianMarketThe so called state monopoly of foreign trade is one of the basic principles governing international economic relations in the socialist type state system, in a planned economy based on socialized means of production. According to Act III. 1974 on Foreign Trade (hereinafter AFT): In the Hungarian People's Republic foreign trade is a state monopoly." (Section 3/1).The most important elements of foreign trade monopoly are well defined by Section 3(2) of the AFT itself. According to this the monopoly comprises, in fact, three important rights respectively obligations of the state:the state develops the international conditions of foreign trade through the conclusion of international agreements and in other ways;it establishes the organisational system of foreign trade, gives authorization to conduct foreign trade activity;manages and controls this activity.According to Section 5 of the AFT foreign trade activities consist in the preparation, conclusion and performance of foreign trade contracts." More specifically, as stipulated by the Decree No. 7/1974 (17. Oct.) of the Minister of Foreign Trade on the Enforcement of the Act on Foreign Trade (hereinafter: DMF), foreign trade activity means actions leading to the conclusion and performance of foreign trade contracts, such as market research, advertising and publicity, supply of information to aliens on the foreign trade price of goods, valuable choses in action, value and services or their terms of delivery, demand of an offer, making an offer, order, bargaining, agreement in certain conditions of the contract, the handing over and acceptance of goods; the assertion of claims arising in connection with a contract or its fulfilment or the defence against such claims. (Section 3/1 of the DFM).A foreign trade contract is, as formulated by the AFT a contract concluded by a national with an alien within the range of economic activity coming under the ruling of this Act." (Section 5(2) of the AFT).A specific definition of what constitutes a foreign trade contract if it is concluded by a national with an alien is provided for by the DFM:contracts of sale and purchase, barter, letting, leasing and deposit contracts concerning goods, including warehousing contracts, commission contracts, the giving or acquisition of preemptive rights (options);contracts for supply and work (location-conductio operis), including job-works ;3
