Preface
The first edition of this book began with an explanation of the need for a student work on the subject. The increase since then in the number of courses on the subject and the appearance of other students' textbooks seems to indicate that repetition of such explanation would be redundant.
The form of the first edition has been kept. The authors are convinced by experience of the value of the initial survey, which is designed to explain as far as possible the references in earlier sections to matters dealt with more fully in later sections. Similarly we have kept to the system of dealing with the modes of carriage before the contracts on which they are based, since the latter are difficult to understand without a knowledge of the former.
Developments in the field of arbitration since the Arbitration Act 1979 have led us to amplify the relevant section and we have thought it advisable to add a short chapter on aspects of European Community law. The sections on bills of lading and other carriage documents have been thoroughly revised to take account of the coming into force of the Carriage of Goods by Sea Act 1992.
We wish to express our gratitude to Witherby & Co for permission to reproduce their bill of lading form, to the Institute of London Underwriters for permission to reproduce their cargo clauses, to the Institute of Export for permission to include their definition of an fob contract in the text and to the International Chamber of Commerce for permission to reproduce the UNCTAD/ICC Rules for Multimodal Transport and the Uniform Customs and Practice for Documentary Credits. We should point out that a revised version of these last rules is due to take effect in 1994.
